Article 33 The president shall be the legal representative of the Bar Association. The legal representative of the Bar Association shall not concurrently act as the legal representative of other social organizations. The legal representative shall be a Chinese mainland resident.

If a decision needs to be made by the legal representative of the Bar Association but the legal representative cannot perform his duties for special reasons, the council shall make a decision and form a resolution according to the principle that the minority is subordinate to the majority.

The president shall exercise the following functions and powers:

(1) preside over the lawyers' representative assembly;

(II) convene and preside over the council;

(III) supervise and inspect the implementation of the resolutions of the council;

(IV) sign important documents of the Bar Association;

(V) exercise other functions and powers granted by the council.

The vice-presidents shall assist the president in the work of the council.

Article 34 The person in charge of the Bar Association shall meet the following conditions:

(1) adhere to the lines, principles and policies of the Party;

(II) have a relatively large influence and a relatively high reputation in the profession of the Bar Association;

(III) be under 70 years of age, being healthy and able to do normal work;

(IV) have full capacity for civil conduct.

Article 35 A person in any of the following circumstances shall not be the person in charge of the Bar Association:

1. a person who was sentenced to public surveillance, criminal detention or fixed-term imprisonment for committing a crime, where not more than five years have elapsed since the date of the completion of the execution of the sentence;

(II) a person who has been deprived of political rights for committing a crime is serving the sentence or was once deprived of political rights;

(III) a person who was the person in charge of a social organization whose registration was cancelled for violating the law and who bore individual LIABILITY for the violating the law, where not more than three years have elapsed since the date of cancellation;

(IV) a person who does not have full capacity for civil conduct.

Article 36 The name list of president, vice president (s), and directors of the Bar Association shall be filed with the governing authorities, registration authorities, and All China Lawyers Association for the record.
